By accessing and using the James Stanfield Company website (stanfield.com) and associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
James Stanfield Company provides educational curriculum, video-based programs, and related materials primarily for special education instruction. Our services include:
- Stanfield+ streaming platform for accessing curriculum content
- Individual product purchases (DVDs, digital downloads, bundles)
- Teacher resources including lesson plans and curriculum guides
- Institutional licensing for schools and districts
3. User Accounts
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and are fully responsible for all activities under your account. You must notify us immediately of any unauthorized use.
4. Subscriptions and Billing
Stanfield+ subscriptions are billed on a recurring basis (monthly or annually). By subscribing, you authorize us to charge your payment method at the start of each billing cycle. You may cancel at any time; see our Refund Policy for details.
5. Intellectual Property
All content on stanfield.com, including videos, curriculum materials, lesson plans, text, graphics, logos, and software, is the property of James Stanfield Company or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Purchasing or subscribing to our products grants you a limited, non-exclusive, non-transferable license to use the materials for educational purposes within your classroom or institution. You may not reproduce, distribute, modify, or publicly display our materials beyond what is expressly permitted.
6. Acceptable Use
You agree not to:
- Copy, share, or redistribute licensed content outside your institution
- Use automated tools to download or scrape content
- Circumvent access controls or digital rights management
- Use the service for any unlawful purpose
- Share login credentials with unauthorized individuals
7. Privacy & Personal Information
We are committed to protecting the privacy of educators, parents, administrators, and students. This section describes what information we collect, how we use it, and your rights regarding that information.
7.1 Information We Collect
When you create an account, request information, sign up for a free trial, subscribe to Stanfield+, purchase a product, or otherwise interact with our website, we may collect the following:
- Contact information: name, email address, mailing address, phone number, school or organization name, job title/role, and grade levels taught
- Account information: username, password (encrypted), account preferences, and subscription status
- Billing information: billing address, purchase history, and payment details (payment card numbers are processed directly by our payment processor, Stripe, and are not stored on our servers)
- Usage information: pages viewed, videos watched, features used, lesson plan and activity usage, login timestamps, device and browser information, IP address, and referral source
- Communications: records of emails, support tickets, contact form submissions, and other correspondence with us
7.2 How We Use Your Information
We use the information we collect for the following purposes:
- To provide, maintain, and improve our services, including delivering curriculum content, processing purchases, and providing customer support
- To create and manage your account and authenticate your access
- To process transactions and send you related information including confirmations, invoices, receipts, and license codes
- To send you administrative and transactional messages about your account, subscription, purchases, and changes to our policies
- To send you marketing and promotional communications about new programs, features, special offers, educational resources, webinars, newsletters, training opportunities, and other information we think may be of interest to you
- To respond to your comments, questions, and requests
- To personalize your experience and recommend content relevant to your role and grade levels
- To monitor and analyze trends, usage, and activities in connection with our services
- To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity

7.3 Consent to Receive Marketing Emails
By creating an account, signing up for a free trial, requesting a quote or sample, subscribing to our newsletter, making a purchase, or otherwise providing us with your email address, you expressly consent to receive marketing and promotional emails from James Stanfield Company. These emails may include, but are not limited to:
- Newsletters and educational content for teachers, parents, and administrators
- New program announcements and product updates
- Special offers, promotional discounts, and limited-time sales
- Free trial reminders and conversion offers
- Subscription renewal reminders and win-back offers
- Webinar invitations, training opportunities, and professional development resources

- Updating your email preferences from within your account settings
Please note that even if you opt out of marketing emails, we will still send you transactional and administrative messages related to your account, purchases, subscriptions, licenses, password resets, security notices, and other essential service communications. These messages are necessary to provide the service you signed up for and cannot be opted out of while you maintain an active account.
7.5 Information Sharing
We do not sell, rent, or trade your personal information to third parties for their marketing purposes. We may share your information in the following limited circumstances:
- Service providers: with trusted third-party vendors who help us operate our business (e.g., Stripe for payment processing, email delivery providers, hosting providers, analytics tools, customer support platforms)
- Within your institution: if you are part of a school or district account, your administrator may see account and usage information
- Legal requirements: when required by law, subpoena, or court order, or to protect our rights, property, or safety
- Business transfers: in connection with a merger, acquisition, or sale of assets, in which case you will be notified
- With your consent: in any other circumstance where you have given us permission to do so
7.6 Student Data, FERPA & COPPA Compliance
James Stanfield Company takes the privacy of students seriously and has designed its services to comply with the Family Educational Rights and Privacy Act ("FERPA"), the Children's Online Privacy Protection Act ("COPPA"), the Protection of Pupil Rights Amendment ("PPRA"), and applicable state student data privacy laws (including but not limited to California's SOPIPA, New York Education Law §2-d, Colorado HB 16-1423, Connecticut Public Act 16-189, and similar statutes).
Privacy by Design
Our core assessment, roster, and classroom features are designed to minimize the collection of student personally identifiable information ("PII") wherever possible. Students are typically represented in our system anonymously using teacher-assigned PINs, nicknames, or initials rather than full names. Teachers are not required to enter student last names, dates of birth, email addresses, home addresses, phone numbers, or government identifiers in order to use our assessment and lesson features. This privacy-by-design approach means that for most classroom use, Stanfield does not store student PII at all.
School Official Designation under FERPA
To the extent that a school, district, or teacher provides us with information from student "education records" (as defined by FERPA, 20 U.S.C. § 1232g), James Stanfield Company acts as a "school official" with a "legitimate educational interest" under 34 CFR § 99.31(a)(1)(i)(B). In this capacity:
- We perform a service or function for which the school or district would otherwise use its own employees
- We are under the direct control of the school or district with respect to the use and maintenance of education records
- We use education records only for the authorized educational purpose for which they were disclosed and do not re-disclose them to third parties except as permitted by FERPA or with written consent from the school or parent
- We do not use student education records for targeted advertising, building student profiles for non-educational purposes, or selling student information
The school or district retains all rights, title, and ownership of student education records. We act solely as a processor/custodian of that data on the school's behalf.
COPPA Compliance (Children Under 13)
Stanfield's services are intended for use by educators, administrators, and parents — not directly by children. We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent or, in the school context, the consent of the school acting in loco parentis as permitted by the FTC's COPPA guidance. When a school or teacher authorizes student access to our services for a school-authorized educational purpose, the school has consented on behalf of the parent under COPPA, and we collect and use student information solely to provide the educational service requested by the school. If we learn that we have inadvertently collected personal information from a child under 13 outside of this school-authorized context, we will delete that information promptly.
What We Do NOT Do with Student Data
- We do not sell, rent, or trade student personal information under any circumstances
- We do not use student personal information to target advertising to students or their families
- We do not build non-educational personal profiles of students
- We do not use student data to train third-party AI or machine-learning models for purposes unrelated to providing our educational service
- We do not disclose student information to third parties except to subprocessors that help us deliver the service (under contractual confidentiality obligations), when required by law, or with explicit authorization from the school or parent
- We do not send marketing communications directly to students
Parental & School Rights
Parents of students whose information is held by Stanfield have the right to review that information, request corrections, and request deletion, in accordance with FERPA and applicable state law. Because we receive student information from schools acting as the data controller, parents should direct such requests to the student's school or district in the first instance. Schools may contact us at hello@stanfield.com to request access to, correction of, or deletion of student records held by us.
Data Retention & Deletion
Upon termination of a school's subscription or upon written request by an authorized school official, we will delete or return student personal information within a reasonable period, subject to our obligation to retain certain records as required by law. Rosters and anonymous assessment results may be retained in de-identified or aggregated form for the purpose of improving our services and conducting educational research, consistent with FERPA's de-identification standards.
Security of Student Data
Student information is protected using the same security measures described in Section 7.8, including encryption in transit (TLS/HTTPS), encrypted storage of sensitive fields, restricted role-based access, and logging of access to student records.
Data Breach Notification
In the event of a confirmed unauthorized disclosure of student personal information, we will notify the affected school or district without unreasonable delay, in accordance with applicable state breach notification laws and any data processing agreement in place with the school or district.
7.7 Cookies & Tracking
We use cookies and similar tracking technologies to operate our website, remember your preferences, keep you logged in, analyze traffic, and measure the effectiveness of our marketing. You can control cookies through your browser settings, but disabling them may affect site functionality.
7.8 Data Retention & Security
We retain your personal information for as long as your account is active, as needed to provide services, and as required to comply with our legal obligations, resolve disputes, and enforce our agreements. We use industry-standard technical and organizational measures to protect your information, including encryption in transit (HTTPS), encrypted password storage, and restricted access controls.
7.9 Your Rights
Depending on where you live, you may have the right to access, correct, update, export, or delete your personal information, and to object to or restrict certain processing of your information. 7.10 California Residents (CCPA/CPRA)
California residents have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate personal information, and the right to opt out of the "sale" or "sharing" of personal information. 7.11 International Users
Our services are operated from the United States. If you access our services from outside the U.S., please be aware that your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country. By using our services, you consent to this transfer.
8. Limitation of Liability
James Stanfield Company provides its services "as is" and makes no warranties, express or implied, regarding the fitness of the materials for a particular purpose. We are not liable for any indirect, incidental, or consequential damages arising from the use of our services.
9. Modifications
We reserve the right to modify these terms at any time. Changes will be effective upon posting to the website. Continued use of the service after changes constitutes acceptance of the revised terms.
10. Governing Law
These terms are governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved in the courts of Santa Barbara County, California.
